This Consumer Health Data Privacy Policy explains how B Pharma Inc. (“B Brand,” “we,” “us” or “our”) handles consumer health data when you use getbbrand.com and our related products, questionnaires, communications and services. It supplements our Privacy Policy. Where applicable consumer health data law requires a different treatment of consumer health data, this policy governs that treatment.
This policy applies to consumer health data covered by applicable law, including Washington’s My Health My Data Act and Nevada’s consumer health data law. Coverage may include residents of those states and other individuals whose data is collected in those states, as defined by the relevant law. Information exempt from those laws, including certain information governed by HIPAA, is subject to the protections and notices that apply to it.
Our role and our healthcare partners
B Brand operates the website, product selection, checkout, customer support and marketing experience. Independent healthcare providers working through MD Integrations conduct clinical intake, evaluate treatment requests and make prescribing decisions. The Pharmacy Hub fulfills prescriptions and provides shipment and tracking updates. Providers and pharmacies have their own privacy notices and responsibilities.
Our educational and marketing questionnaires are separate from the clinical questionnaire used to evaluate a prescription. We process website answers, preferences, requested product or dose, order information, intake-completion information and shipment updates as relevant to our services. B Brand does not make prescribing decisions. This policy does not replace a provider’s or pharmacy’s Notice of Privacy Practices.
Consumer health data we collect
Depending on how you interact with us, consumer health data we process may include:
- Sexual or reproductive health interests and information you choose to provide, including information relating to ED treatment or DoxyPEP.
- Products or treatments you seek, select or purchase, including a requested medication or dose and related order history.
- Answers to optional educational or marketing questionnaires, preferences and profiles derived from those answers when they reveal or support an inference about health.
- Health-related information you voluntarily include in messages to customer support, together with information needed to coordinate your requested services, such as intake completion and medication shipment information.
- Website activity that identifies or suggests that you are seeking healthcare services, including health-related pages viewed or forms used, when linked or reasonably linkable to you.
Identifiers such as an email address, IP address, cookie identifier or device identifier may form part of consumer health data when connected to health-related information. We collect only the categories relevant to your interaction; visiting our website does not mean we collect every category above.
Sources of consumer health data
We receive data from you when you use questionnaires, select products, place orders or contact us; from your browser or device through website interactions and permitted tracking technologies; and from service partners when needed to coordinate your request, including intake-completion information from MD Integrations and shipment or tracking updates from The Pharmacy Hub. We may derive preferences or profiles from information you provide or permitted website activity. Our Privacy Policy describes other personal information we collect.
How we use consumer health data
We use relevant consumer health data to provide products and services you request; process and coordinate orders; facilitate your handoff to independent healthcare providers and pharmacies; provide customer support and necessary communications; protect our services against fraud or misuse; and meet applicable legal obligations.
Where permitted and with consent when required, we also use information to personalize educational content and optional marketing, understand and improve the website experience, and assess the effectiveness of our communications. You can decline optional health-based personalization or withdraw consent using Your Privacy Choices or by contacting us. Declining optional marketing does not prevent you from requesting available products or services.
When applicable law requires consent for collection or sharing, we obtain it before that activity. Consent to sharing is obtained separately from consent to collection where required. Publishing this policy, visiting our site or accepting general terms does not substitute for required consent.
Data shared and recipients
We share the relevant categories described in this policy only for permitted purposes, subject to required consent and applicable law. Relevant product selections, order details and identifiers may be shared with healthcare providers and pharmacies to coordinate services you request. Information needed for operations may be processed by vendors providing website hosting, checkout, payment processing, order management, secure data storage, customer support, email or text delivery and consent management.
Where permitted and with required consent, website usage information and related identifiers may be disclosed to analytics or advertising partners, including Google and Meta. Such partners may collect information over time and across websites or services. Health-related browsing can itself reveal health interests. Your Privacy Choices provides controls for eligible advertising and sale/sharing activities; Cookie settings provides additional cookie controls. These disclosures remain subject to consumer health data restrictions, even when cookies or server-side technologies are used.
We may also disclose relevant information to professional advisors, in connection with a business transaction, to comply with lawful obligations or protect legal rights, or at your direction, in each case only as permitted by applicable law. A successor receiving data must honor applicable obligations.
Corporate affiliates receiving consumer health data: We do not share consumer health data with corporate affiliates. Independent providers and pharmacies are not listed as affiliates solely because they serve our customers.
We do not sell consumer health data. Sharing for advertising may nevertheless qualify as sale or sharing of personal information under other privacy laws. The Privacy Policy and Your Privacy Choices explain the applicable controls.
How we process and protect data
We process consumer health data through our website, order-management and customer-service systems and through vendors acting for us under appropriate contractual restrictions. We use administrative, technical and physical safeguards designed to protect the data and limit access to authorized people and service providers who need it for permitted purposes. No system is completely secure.
If we use deidentified data, we maintain it in deidentified form, do not attempt to reidentify it except as permitted by law, and require recipients to observe applicable restrictions. We retain consumer health data only for permitted purposes and applicable retention requirements, and honor deletion requests as required by law, including obligations involving processors and backups.
Your rights and how to submit a request
Depending on applicable law, you may have rights to confirm whether we collect, share or sell your consumer health data; access that data; obtain information about recipients, including contact information where required; withdraw consent to collection or sharing; and request deletion. You may also contact us to review information we hold or request a correction. We will evaluate requests under applicable law.
Use Your Privacy Choices on our website for cookie and advertising controls and the link to submit an account or health-data request. You may also email info@getbbrand.com with the subject “Consumer Health Data Request.” Describe your request and provide the email associated with your interaction with B Brand. Please do not send medical records or government identification by ordinary email.
We may need to verify your identity or an authorized representative’s authority before acting on an account or health-data request. We use information reasonably necessary for verification and request additional information through an appropriate secure method when needed. You do not need to create a new account to submit a request. Browser advertising opt-outs do not require account verification.
We respond within the time required by applicable law and explain any permitted extension. If we deny a request, we explain the reason and how to appeal. Submit an appeal to info@getbbrand.com with the subject “Consumer Health Data Appeal.” We review it and provide the outcome and information about contacting the appropriate attorney general when required.
Withdrawing permission or deleting information necessary to fulfill a requested service may prevent us from completing that service. Optional advertising and personalization choices do not prevent ordering or necessary order communications. Requests involving records held independently by a provider or pharmacy may also need to be directed to that organization; we will explain the appropriate route where relevant.
Policy updates
We may update this policy to reflect changes in our services, practices or legal requirements. We update the dates above and provide notice of material changes through the website or other appropriate communications as required by law. We obtain any newly required consent before new collection, uses or sharing; continued use of our website is not a substitute for that consent.
